Yes. Estate planning is not limited to reducing estate taxes. It also identifies who should receive your property, who can manage financial matters if you become incapacitated and who can make health-care decisions on your behalf. Without valid documents, state law and court procedures may determine outcomes that do not match your wishes. A basic plan may include a will, durable power of attorney, health-care documents and coordinated beneficiary designations. Some families may also benefit from a Trust. The complexity should match your circumstances, but nearly every adult can benefit from clear instructions and properly selected decision-makers.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

Not everyone needs a Trust. A revocable living trust can help manage property, provide instructions for control during incapacity, and in some cases avoid probate, which can be public, lengthy, and expensive. But trusts are legal documents, and the right choice depends on your assets, family structure, state law, privacy goals, and who should manage things if you cannot. A Trust is sometimes useful, not automatically necessary. Legal drafting of estate documents is generally handled by an estate attorney.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

What is the difference between a Will and a Trust?<\/h3>\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t

The core difference is when they take effect and whether the court gets involved. A will is a set of instructions that takes effect only at your death: it names who inherits, who serves as executor, and who becomes guardian of minor children \u2014 but it must go through probate, the court-supervised process that validates the will and distributes assets, which is public record and commonly takes six months to two years. A trust \u2014 most often a revocable living trust \u2014 is a legal container that works during your life and after death: assets you retitle into it are managed by you as trustee, pass directly to beneficiaries without probate, stay private, and can be managed seamlessly by a successor trustee if you become incapacitated. A will covers only assets titled in your individual name; a trust covers only assets actually transferred into it. Neither controls retirement accounts or life insurance, which pass by beneficiary designation regardless of what either document says.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t

Review estate documents and beneficiary designations regularly and after major life changes, such as marriage, divorce, the death of a spouse, a move, or major health or financial changes. We recommend reviewing plans at least once each year and when major life events occur and updating outdated beneficiary designations. Beneficiary forms on retirement accounts and insurance policies can override instructions in a will or trust, so both should be checked together.<\/p>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t
